Terms of Service

NaiHive is strictly for adults aged 18 years or older. You must be legally able to enter a contract where you live and must not use the Service if doing so would violate the law that applies to you. You confirm your age when you create an account. We do not require you to submit an identity document to register, to publish a profile, or to use any feature, but we may suspend or remove an account where age, consent, or legality cannot reasonably be established, and we may ask for information in that situation.

You must provide a real email address that you can access. Email verification is required before sign-in. You are responsible for keeping your password, one-time codes, and account access confidential and for all activity performed through your account.

NaiHive is a user-generated directory and advertising platform. We provide tools for users to create profiles or adverts, publish selected information, discover other listings, and contact one another. We do not employ, represent, endorse, supervise, or guarantee any listed person, venue, agency, advertiser, client, or other user.

We are not a party to arrangements between users and do not arrange, broker, facilitate, negotiate, collect payment for, or guarantee any offline meeting, service, employment, accommodation, transportation, or other transaction between users. A listing, verification status, review, search result, or promotion is not an endorsement, safety guarantee, or representation that a user is trustworthy, available, qualified, or lawful.

You are solely responsible for deciding whether, how, and with whom to communicate or meet. Read our Safety guidance, protect your identity and money, and contact appropriate authorities in an emergency.

• Use one account for yourself and do not sell, lend, transfer, or share it.
• Keep your name, age-related information, contact details, location, availability, and other submitted information accurate and current.
• Do not impersonate another person, organisation, or public figure, or use information or images without permission.
• Notify us promptly if you suspect unauthorised access, a compromised password, or misuse of your account.
• Do not create a new account to evade a suspension, deletion, moderation action, payment reversal, or other restriction.

You keep ownership of content you submit, subject to the rights of other people and licensors. You grant NaiHive a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, format, resize, moderate, display, index, distribute, and otherwise use that content as needed to operate, secure, improve, and promote the Service. This licence ends for public display when you delete the content or account, except where retention is reasonably necessary for legal, safety, fraud, payment, backup, or dispute purposes.

You represent that you have all rights and permissions needed for your content and that it does not violate another person's privacy, publicity, copyright, trademark, or other rights. You are responsible for obtaining consent from every identifiable person shown or described in your content and for removing content when that consent is withdrawn or no longer applies.

Do not submit or publish content that:

• depicts, sexualises, solicits, exploits, grooms, or endangers a minor, or suggests that a minor is available;
• promotes trafficking, forced labour, coercion, abuse, exploitation, violence, or non-consensual sexual activity;
• contains intimate images or personal information shared without the person's informed permission, including doxxing or blackmail;
• is unlawful, fraudulent, defamatory, hateful, threatening, discriminatory, misleading, or designed to facilitate harm;
• uses stolen, manipulated, or materially misleading identity, age, verification, location, pricing, or availability information;
• contains malware, hidden redirects, unauthorised advertising, spam, or links intended to steal credentials or payment information; or
• offers or requests anything that is prohibited by applicable law or these Terms.

Messages, reviews, reports, blocks, and other interactions must be lawful, truthful, respectful, and relevant. Do not harass, threaten, stalk, extort, defraud, spam, or continue contacting someone who has asked you to stop or has blocked you. Do not share passwords, one-time codes, payment credentials, identity documents, or another person's private data through messages.

You may report a listing or user and block accounts. Reports may be reviewed by NaiHive staff and may be retained as safety and moderation records. We may limit visibility, remove content, disable messaging, require verification, or take other action while investigating. We do not promise that every report will be accepted or that every harmful interaction can be prevented.

We may, but do not have to, review content and activity using rules, automated checks, and human review. We may edit or remove content; decline publication; mark, limit, or demote a listing; restrict features; suspend; or permanently terminate an account where we reasonably believe there is a breach of these Terms, a safety or legal risk, fraud, abuse, non-payment, or a request from a competent authority.

Identity verification is optional. We intend to offer a voluntary identity check that an account holder may start themselves, at a time of their choosing, in exchange for a verification badge on their profile. It is not available yet. When it launches, taking part will be entirely your choice: you will never have to submit an identity document to register, publish, be found in the directory, receive messages, or buy promotion, and declining costs you nothing except the badge itself. Until then, a badge is applied at our discretion and does not certify identity. A badge of either kind is not a guarantee of any profile claim, of a person's conduct, or of the outcome of any meeting or transaction, and we may add, withhold, or remove one.

We may preserve and disclose information where reasonably necessary to investigate abuse, protect users or the public, enforce these Terms, process payments, or comply with law. We may act without advance notice where notice could increase risk or interfere with an investigation. Where appropriate, you may contact us through the support channel published on the Site to request review of an action.

NaiHive may offer paid profile promotion or classified-ad placement for the plan and period shown at checkout. Prices are shown in Kenyan Shillings unless stated otherwise and may change for future purchases. An active VIP or Premium plan provides paid placement, the paid media allowance and activates its linked paid profile for the plan period. It does not guarantee views, enquiries, meetings, income, rankings, or results.

Payment is processed by the provider displayed at checkout, which may include M-Pesa, SasaPay, or Paystack. We do not receive or store your card number, mobile-money PIN, or payment-provider password. We retain operational payment records such as provider, amount, currency, status, references, receipt details, and linked listing for reconciliation, accounting, fraud prevention, disputes, and legal obligations.

Unless applicable law requires otherwise, payments are final and non-refundable. We do not provide credits, exchanges, or pro-rated refunds when you change your mind, stop using the Service, delete a listing or account, receive fewer results than expected, or are removed for violating these Terms. Cancelled or declined prompts are not refunds because no completed payment has been applied. If a duplicate charge is caused by a verifiable system error, contact us before initiating a dispute so we can investigate and correct the record. A fraudulent or abusive chargeback may result in suspension, without limiting your legal rights.

The Service, including its software, design, branding, text, databases, and non-user materials, belongs to NaiHive or its licensors and is protected by applicable law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose.

You must not, unless we expressly authorise it or the law permits it:

• scrape, crawl, harvest, mirror, bulk-download, index, or commercially reuse the Service or user data;
• reverse engineer, decompile, bypass access controls, probe vulnerabilities, or interfere with the Service;
• use bots or automation to create accounts, send messages, inflate views, evade limits, or manipulate rankings; or
• remove attribution, reproduce our branding, or imply that NaiHive endorses you or your content.

The Service is provided on an "as available" and "as is" basis. To the fullest extent permitted by law, we disclaim warranties that the Service or any listing will be accurate, uninterrupted, secure, timely, suitable for a particular purpose, or free from errors, harmful content, or unauthorised access. We may change, pause, restrict, or discontinue any feature without guaranteeing continued availability.

Nothing in these Terms excludes or limits liability, a consumer right, or a remedy that cannot lawfully be excluded or limited. To the fullest extent permitted by law, NaiHive is not liable for indirect, incidental, special, consequential, exemplary, or loss-of-profit damages arising from user content, user conduct, offline arrangements, payment-provider actions, or use or inability to use the Service.

To the extent permitted by law, you agree to defend and indemnify NaiHive and its officers, employees, contractors, and service providers against claims, losses, liabilities, costs, and reasonable expenses arising from your content, your use of the Service, your breach of these Terms, your violation of another person's rights, or an arrangement you have with another user. This does not require you to indemnify us for our own fraud or liability that cannot legally be transferred to you.

You may request account deletion from your account settings. Deletion marks the account as deleted and disables access. Account-linked content, credentials, and records are retained unless removal is required by law or a separate retention rule applies.

Sections concerning content licences, payments, intellectual property, disclaimers, indemnity, disputes, and records that must be retained survive suspension, termination, or deletion to the extent necessary to give them effect.

These Terms are governed by the laws of Kenya, subject to any mandatory consumer protections that apply to you. Courts with jurisdiction in Kenya will have jurisdiction unless applicable law gives you a different right. We may update these Terms by posting a new version. The "Last updated" date will change when we do. If a change is material, we will provide a reasonable notice where practical; continuing to use the Service after the effective date means you accept the updated Terms.

If any provision is unlawful or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will continue. These Terms and the Privacy Policy are the agreement between you and NaiHive about the Service, except for any additional terms shown for a particular feature or payment provider.
